** AIR QUALITY PERMIT UPDATE ————————————————————
On Aug. 14, an Arizona Administrative Law Judge ruled against Save the Scenic Santa Ritas, the Center for Biological Diversity, and Farmers Investment Company in our appeal of Copper World’s Class II Clean Air Permit issued by the Arizona Department of Environmental Quality.
The appeal challenged the ADEQ’s decision to issue a Class II permit instead of a more rigorous Class I permit that would require more advanced air pollution controls. The ALJ did not provide an explanation for his decision. The next step in the administrative process is for ADEQ to accept or reject the ALJ’s ruling.
We expect ADEQ will accept the ruling. When this occurs, it will provide us with the opportunity to move our appeal out of the administrative review process and into Maricopa County Superior Court where we are hopeful our sound legal arguments will prevail.
** WHAT’S HUDBAY HIDING? ————————————————————
Hudbay claims to have a “smart” water management plan that will “recharge and recycle as much water as we use.” In the second installment of our “What’s Hudbay Hiding?” series, Executive Director John Dougherty uses state data to reveal that Hudbay’s reliance on Central Arizona Project water falls far short of replacing all the groundwater Copper World would consume. On Sept. 11, the Arizona State Land Department’s Board of Appeals approved Copper World’s application for a 160-acre parcel of land, despite letters from SSSR (drive.google.com/file/d/1zNspXgFfFECrB16kSIFY9zwFuRuc0YQg/view?usp=drive_link) , the Tohono O’Odham Nation (drive.google.com/file/d/1JouUtES5Wz5JVS1f_wnQjtBBVrwauRGp/view?usp=drive_link) , and hundreds of citizens asking Copper World’s request be withdrawn.
Commissioner Robyn Sahid, who was appointed by Governor Katie Hobbs, will make the final determination on whether to put this land up for auction. Selling the land to Copper World would allow the company to dump mining waste immediately south of Corona de Tucson.
